Personal Injury

My office represents persons injured in automobile accidents on a contingency basis, receiving a legal fee only after the case is settled. I still charge the same percentage fees as I did when I started practicing law in 1972, to wit: 25% of settlement outside of court, 33 % of judgment on settlement after a lawsuit is brought.

Many attorneys say they are willing to handle your personal injury claim, but they may not have the skills or experience to successfully litigate your claim in court. Should the insurance company deny your claim, or offer you only minimal compensation, such attorneys will either persuade you to accept an unreasonably low settlement, refer you to some other newer attorney in their firm, or simply drop your case with instructions on the statutory time limits applicable to bringing your claim to court.

1. Investigation

My experience has shown that the prompt and through investigation of an accident can result in the discovery and preservation of important evidence and the documentation of relevant facts.

2. Preparation

Proper preparation of a case depends upon a through investigation of the facts and a complete analysis of those facts as they relate to the relevant law. Consultation with appropriate experts and other case management activities are all part of proper case preparation and result in fair, just, and reasonable monetary compensation for the injuries and losses sustained.

3. Maintaining Contact with the Client

To successfully pursue your claim, regular contact between attorney and client is a must. This is part and parcel of proper representation. This also prevents "surprises" and/or misconceptions, and any problems that may arise are quickly addressed and resolved.

4. Trial or Settlement

It has been statistically shown that most cases of a civil nature in North Carolina are resolved by settlement. My experience has been that each case, when fully investigated and properly prepared for trial, is more likely to settle and is more likely to settle for an adequate, fair, and just sum than those not so prepared.

5. Attorney's fees

I represent my personal injury clients on a contingency fees basis. This means that my fee is paid out of the recovery and if there is no recovery, there is no fee. If there is a recovery, the client is responsible to reimburse Attorney Paul L. Pawlowski for all costs he has advanced and that were necessary to prosecute your case from the proceeds of the recovery.

6. Dos and Don'ts

If you believe that an accident involves a serious injury and/or property damage you should do the following:

  1. Do not move your vehicle before the police arrive unless it is necessary for the safety of yourself or others, or the vehicles involved are impeding traffic.
  2. See if there are any witnesses to the accident other than the driver and/or passengers in the vehicles involved. Get the full names, addresses, and phone numbers of these witnesses and make sure the investigating officer gets this information also.
  3. Go see a doctor immediately if you are injured.
  4. Take a photograph of the area where the accident occurred, and of the damage to the vehicle in which you were driving or riding.
  5. Maintain a log indicating your pain and discomfort and any financial losses you have suffered, such as lost wages.
  6. Take pictures of your injuries, if they are visible.
  7. Determine if there are any witnesses to your pain, discomfort, or obvious physical problems you have resulting from your injuries and list their full names, addresses, and phone numbers.
  8. A co-worker or a friend who can attest to your pain is far more persuasive than the self-interested testimony of the plaintiff himself.
